How Long Do You Have to File an Auto Accident Claim in Florida?

If you’ve been injured in an auto accident in Florida, time is not on your side. Florida law sets strict deadlines for filing claims related to car crashes. Missing these deadlines can mean losing your right to seek compensation for your medical bills, lost wages, pain and suffering, and other damages.

Here’s what you need to know about time limits for filing an auto accident claim.


Florida’s Statute of Limitations for Auto Accidents

The statute of limitations is the legal deadline for filing a lawsuit. In Florida:


For most personal injury cases from auto accidents, the statute of limitations is 2 years from the date of the accident (as of recent changes in Florida law).


For wrongful death claims resulting from a fatal auto accident, you also have 2 years from the date of death to file suit.

If you miss these deadlines, the court will likely dismiss your case, no matter how strong your claim might be.
